The Ivory Lane Creations website is operated by C M Laubsch, K L Trevean & S Wilson trading as Ivory Lane Creations (ABN: 88 556 471 289). Your use of the website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below ('Terms and Conditions'). You should read them now. Your use of the website constitutes your agreement to the Terms and Conditions.

Ivory Lane Creations reserves the right to amend the Terms and Conditions at any time and without notice to you. Your continued use of the website after any amendment constitutes an agreement by you to abide and be bound by the Terms and Conditions as so amended.

The products on the website are only available for sale to individuals who can make legally binding contracts. The products are not available to persons under the age of 18 years and any other persons who are legally prohibited from entering into binding contracts.

Any order placed by you in the manner described in this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this website at the time you place your order on these Terms and Conditions. Ivory Lane Creations reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website or an error in your order. Your contract with Ivory Lane Creations only comes into existence when it forwards confirmation of receipt of your order and payment.

Prices:

Prices of products and services and delivery and other charges displayed on this website are current at the time of issue, but may change at any time and are subject to availability. All prices displayed are exclusive of delivery & handling charges. These costs are additional to the listed product price.

Goods and Services (GST) and other Taxes:

Prices displayed on this website are inclusive of GST applied at the rate of 10%.

Delivery:

Please read the Delivery Information contained in this website. The delivery times are indicative only and Ivory Lane Creations will not be liable for any failure to observe these delivery times.

Risk and Title:

Ivory Lane Creations will retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you upon their delivery to or collection by a postal or courier service. You should consider whether to obtain any suitable insurance.

Refunds:

The circumstance in which Ivory Lane Creations is obliged to make a refund, the guidelines for eligibility are detailed in its Refund Policy.

Limitation of Liability:

Ivory Lane Creations will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorised access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if Ivory Lane Creations has been advised of the possibility of such damages.

     A: The replacement of the goods or supply of equivalent goods
     B: The repair of such goods
     C: The payment of the cost of replacing the goods or of acquiring equivalent goods
     D:The payment of the cost of having the goods repaired; and
2.If the breach relates to services
     A:The supplying of services again; or
     B. The payment of the cost of having the services supplied again.

Ordering, Delivery and Returns

Ordering

When placing an order, it is the purchaser's responsibility to ensure that all details conveyed in the order are correct & true. Ivory Lane Creations does not accept liability for products sent with errors made by the ordering party. Due to the custom nature of the products offered by Ivory Lane Creations, full payment must be received for all orders before any goods are dispatched.

Delivery and Handling Charges

Ivory Lane Creations delivers Australia wide via Australia Post. All delivery and handling charges are payable by the purchaser and are additional to the listed price for each product on this website. Should the delivery charges in anyway be unclear or not understood, you should contact us at enquiries@ivorylane.com.au with your query.

Estimated Delivery Time:

Orders are dispatched from Ivory Lane Creations in Victoria, Australia. Your products should be delivered to you within 1-4 weeks of receipt of order, payment & advice of correct information relating to the products required or at a mutually agreed date. Delivery time may also be affected by the size or complexity of your order, the delivery location & our current workload. An estimate for job completion & delivery can be requested before or after making an order. Ivory Lane Creations relies on Australia Post for delivery and unfortunately delays may occur that are beyond our control. We are not liable for delays whatsoever.

Method of Delivery:

By default, all orders within Australia are sent via Regular Post, customers must advise if they require their products be; (A) insured (B) sent via Registered Post (C) sent via Express Post or otherwise. A revised quote for delivery will be issued if either A, B or C be nominated for delivery. We recommend that orders be dispatched with insurance & postal registration. Pick-ups are available by prior arrangement only.

Policy for Returning Items:

Refunds and exchanges are not accepted due to the custom & personal nature of our products. Products are non-returnable unless there is a known manufacturing fault or defect.

Defective Items:

Defective products must be returned to Ivory Lane Creations within (14) fourteen days of the delivery date to be eligible for replacement. Items will be replaced with the product originally purchased. For products that cannot be replaced due to unavailability, a full refund will be offered.

How to Return your product:
1. Contact Ivory Lane Creations at enquiries@ivorylane.com.au. A representative will evaluate your return request and record all the necessary product return information and issue you with a Return Authorisation Number (RAN). You will also be provided with address details of where to send your return. You should not send your item without an "RAN"
2. Send your item to the return address provided with your RAN clearly displayed on & inside the return packaging.
3. As soon as the return has been received, a replacement product will be forwarded.

Important:

The return must be received by Ivory Lane Creations within (14) fourteen days of the RA Number being issued.
Replacement products will only be forwarded after the faulty item has been received by Ivory Lane Creations.
All returns must have an RAN Number.
Products that are returned to Ivory Lane Creations without an RAN will be returned to sender.

If you feel that your return falls outside of our policy, please contact our customer representative at enquiries@ivorylane.com.au first to confirm if your return can be accepted.

Privacy Policy

Ivory Lane Creations (ABN: 88 556 471 289) is covered by the National Privacy Principles as set out in the Privacy Act 1988 and amended by the Privacy Amendment (Private Sector) Act 2000).

Complaints

Ivory Lane Creations is unable to deal with anonymous complaints as we are unable to investigate properly and follow-up such complaints. However, in the event that an anonymous complaint is received we will note the issues raised and try and resolve them appropriately.
